Isaac Has a Camera — Photography & Videography Services

Thanks for considering working with me! These Terms & Conditions (“Terms”) explain how I work with clients on photography and videography projects, so we’re both clear on what to expect from start to finish. They apply to all services provided by Isaac Macias / Isaac Has a Camera (“Photographer,” “I,” “me,” “my”), and by booking a session, paying a deposit, or otherwise engaging my services, you (“Client,” “you”) agree to them.

Every project also gets its own scope, deliverables, and price, confirmed separately in writing (email or text) before booking. If anything in that written confirmation differs from these Terms, the project confirmation is what governs for scope and price—these Terms cover everything else.

1. Booking & Deposits

  • To reserve your date, I ask for a non-refundable deposit of 30% of the total project fee. I hold dates on a first-deposit-received basis, so booking early helps guarantee your spot.
  • The remaining balance is due once your final files are complete and delivered, unless we’ve agreed to a different payment schedule in writing.
  • Quotes given in conversation or over the phone are a starting estimate. I’ll always confirm final pricing in writing (text, email, or invoice) before it’s official.
  • Booking a session in any form (a deposit, a signed confirmation, or a verbal yes on a written quote) means you’re agreeing to these Terms.

2. Payment Terms

  • Final, high-resolution photos and finished video exports go out once the project is paid in full.
  • Invoices are due within 14 days of when you receive them, unless we’ve talked through a different timeline.
  • If a balance goes unpaid past the due date, a late fee of 2% per month applies to the outstanding amount.

    • Zelle
    • ACH Bank Transfer
    • Cash

3. Client Preparation

  • I photograph and film what’s in front of me on shoot day, so it helps a lot if your space, subjects, and any styling or wardrobe are ready to go beforehand. I’m happy to offer tips ahead of time, but I’m not able to guarantee results for things outside of prep, like a messy space or last-minute styling changes.
  • For video projects where you or your team will be speaking or acting on camera, having a script or talking points prepared and practicing beforehand makes a big difference in how efficiently we can shoot. If a session runs long because content wasn’t prepared in advance, that time is still billed as part of the session, since it’s time reserved just for your project.
  • For events or live-action moments, I shoot based on the plan and details you share with me ahead of time. Because I can only capture what I know to expect, I can’t guarantee catching a moment that happens differently than planned, out of sequence, or off-camera — so the more detail I have going in, the better I can deliver what you’re hoping for.

4. Scheduling, Lateness, & Cancellations

  • Sessions begin at the scheduled start time, with a 15-minute grace period built in. After that, I’ll get started with whatever time remains, but the session length stays as originally booked, so a late start may mean a shorter shoot.
  • I can’t refund a deposit for a session cancelled within 48 hours of the scheduled shoot time. At any point before that 48-hour period, I’m happy to help you find a new date or refund your deposit.
  • On my end, if illness, an emergency, or unsafe conditions (like severe weather for outdoor shoots) come up, I’ll reach out as soon as possible to reschedule with no penalty to you.
  • If lateness (arriving after the 15-minute grace period) or a no-show happens more than once on the same project and it ends up requiring an extra session to finish the work, a $50 rescheduling fee may apply to help cover the added time.

5. Revisions & Reshoots

  • Every project includes one round of revisions on selected images or an edited video — just let me know what you’d like changed within 7 business days of delivery. Beyond that first round, additional revisions are billed in half-hour increments at $80/hr.
  • Sometimes a client wants to reshoot for personal reasons — a different take on camera, a wardrobe change, a new idea after the fact. Since that’s new work, it’s treated as its own project with a new quote and deposit rather than an extension of the original one.
  • The sooner I receive feedback or approval on delivered work, the sooner we can call a project finished and I can hand off the final files to you. If I don’t hear back within 7 business days of initial delivery, I’ll treat the project as on-pause until I hear from you. If it stays paused for more than 30 days, picking it back up will include a $50 restart fee to cover getting re-familiarized with the footage and finding new time on the schedule.
  • Once we’ve signed off on a script, shot list, or concept together, I’ll treat it as final. If new changes come up after that, I’m happy to make them, but they’ll be handled as a new revision and billed accordingly.

6. Turnaround Time

  • Most projects are delivered within 2–4 weeks of the final shoot day, depending on scope.
  • That timeline is just an estimate. It can shift a bit if feedback takes longer, prep wasn’t done ahead of time, or extra changes come up along the way.
  • Rush delivery is available for an additional fee, subject to availability. Just ask if you need something sooner.

7. Copyright & Content Ownership

  • Unless clearly discussed and confirmed otherwise in writing, I hold copyright on all the photos and video I produce, no matter the file format delivered.
  • Once a project is paid in full, you get a license to use the final delivered images/video for the purposes we agreed on at booking (e.g., your business website, social media, marketing materials). That license doesn’t transfer copyright, and doesn’t cover reselling, sublicensing, or using the content beyond what was agreed without confirming with me first.
  • I ask that any content from a session remain private and unpublished until the project’s paid in full. It just helps make sure that we’re both squared away before anything goes public.
  • Unless we’ve agreed otherwise in writing, I love sharing select images and video from sessions in my own portfolio, website, and social media. If you’d rather I not, just let me know and we’ll work it out.

8. Model Releases

  • For sessions involving people beyond just you (team members, family, customers, and so on), the client is responsible for obtaining permission to photograph them and use their image as described here, unless I’m collecting a signed release directly.
  • For any session involving minors, I ask for a signed parent or guardian consent form before we shoot, or at least before anything is delivered or published.

9. Travel & Other Expenses

  • Sessions within 50 miles of Emerald Isle are included in the base rate. Beyond that distance, travel may include an additional fee of $0.50/mile, which I’ll factor into your quote at my discretion.
  • Every quote reflects the specific scope we’ve agreed on, so if something in the plan changes (like added travel, more time, or extra deliverables), I’ll factor that into an updated quote rather than adjusting the price for the same scope.

10. Liability & Limitations

  • I take great care with my gear and back up files as a matter of course, but every once in a while things happen that are outside anyone’s control — including but not limited to equipment failure, file corruption, extreme weather, or venue restrictions. If that ever limits what I can deliver, I’ll refund the portion of fees tied to the affected work.
  • To keep things fair for both of us, my liability for any project is capped at the amount you paid for it.
  • I do my best to capture everything on the agreed shot list, but I can’t promise to catch a moment that wasn’t part of the plan or wasn’t shared with me ahead of time.

11. Confidentiality

  • If your work involves sensitive or proprietary information (healthcare, legal, or similar fields) I’ll treat anything non-public I come across during a project as confidential and won’t share it outside our work together.

12. General

  • I may update these Terms from time to time. The version posted on my website at the time you book governs your project. If I make changes after you’ve booked, they won’t apply retroactively to that project unless we agree to them in writing.
  • These Terms, together with the written confirmation for your specific project, make up our entire agreement.
  • These Terms are governed by the laws of the State of North Carolina.
  • Any dispute arising from these Terms or a project between us will be resolved in the state or federal courts located in Carteret County, North Carolina, and both of us agree that this is the proper venue and consent to jurisdiction there.
  • If a court finds any part of these Terms invalid or unenforceable, that part will be limited or removed only to the extent necessary, and every other part of these Terms will remain in full effect.
